Anhörung. Hearing. A discussion open to the public in which subject area experts are asked their opinion; statements given by witnesses; a questioning of participants and or witnesses in a conflict.

Ursache. Cause; from the beginning, start, origin; the reason for a court proceeding; something which causes an event, a development; the immediate and actual cause; to investigate, identify, establish the cause; the law of cause and effect.

eindämmen. Containment; to control the flow of water via a dam; to influence or steer the direction of something; to limit the spread of something, wildfire, costs, crime; to limit another person‘s influence.

heraufbeschwören. To bring about a negative event or development; thoughtless provocation of something negative, destructive; to cause a danger, a conflict.

Verzögerte Anhörung. A delayed hearing. German mediators reserve the right to call a hearing with both conflict parties present, but at a later stage in the resolution process.

Verleumdung. To bear false witness against another person; to damage someone‘s honor by making an untrue accusation; to knowingly state a falsity about the other conflict party; lie, defamation.

Litigious

Litigious: To be litigious means to argue, to contend, to take your dispute to the courts. American society has become very litigious. With a population of roughly 310 million people, the U.S. has 1.2 million attorneys, 200 law schools, graduating approximately 45,000 lawyers each and every year. The court of law is where conflict is resolved.

How conflict is resolved is foundational to any society. It is a system for balancing out conflicting interest. Conflict resolution is so central to our daily lives, in so many or our interactions, that we are continuously fascinated by how they play out.

This fascination is the reason why many movies and television shows are based on the law and legal proceedings. Among the most popular in the U.S. were: L.A. Law (1986-94), the classic Perry Mason (1957-66), The Defenders (1961-65), Law & Order (1990-2010).

The popularity of these shows has led to the reality court room shows, a combination of reality television and the workings of the American legal system. The best known are Judge Judy, The People‘s Court and Divorce Court.

Resolve

Conflict: Fight, battle, war; competitive or opposing action of incompatibles; antagonistic state or action as of divergent ideas, interests, or persons; mental struggle resulting from incompatible or opposing needs, drives, wishes, or external or internal demands; the opposition of persons or forces that gives rise to the dramatic action in a drama or fiction. From Latin conflictus act of striking together, from confligere to strike together.

Escalate: To increase in extent, volume, number, amount, intensity, or scope. From escalator.

Resolve: Break up, separate; to reduce by analysis; to deal with successfully, clear up; to find an answer to; to make clear or understandable; to reach a firm decision about; to declare or decide by a formal resolution and vote; to make (as voice parts) progress from dissonance to consonance; to become separated into component parts; From Latin resolvere to unloose, dissolve, release.

Ultima ratio

German workers do not like to strike. It is considered the ultima ratio – weapon of last resort – used only when negotiations about wages and worker‘s rights have completely broken down.

In 2002, when the German government passed painful but necessary social and employment reforms, there were strikes in 938 companies. In 2000 there was not a single strike. 2001 saw only 48 strikes. A decade later, in 2011, there were 158. On average only three days a year are lost due to strikes in Germany.

Ultima ratio. Latin ultimus, the last, final, the furthest away. ratio: reason, reasonable thoughts; the last possible solution, the final remaining path out of a conflict.

Friedenspflicht. Literally peace obligation or obligation to keep the peace. When German employers and employees enter into wage negotiations they are obligated for the first ten days to refrain from strikes or lockouts.

The Friedenspflicht is anchored in §74 of the Betriebsverfassungsgesetzes, the law governing the relations between employers and employees:

The employer and the works council (a kind of white collar union) should meet at a minimum once per month in order to discuss potential conflicts and to propose in good faith recommendations on how to resolve them. The employer and the works council are obligated to refrain from methods of pressure – strikes, lockouts, etc. – which could disrupt company operations.

In 1923, during the politically unstable Weimar Republic, the Stresemann government passed laws requiring a mediator to resolve conflicts between employers and labor. Should companies and labor unions not come to agreement on wages and other benefits, the government had the power – and the obligation – to engage an arbitrator, whose decisions were legally binding.

German schools train both students and teachers to anticipate and prevent potential conflicts, as well as to mediate those which have been escalated.

The Prussian military instituted a rule informally called the Prussian Night, which obligated conflict parties to not escalate their problems within the first 24 hours of the conflict. Those in conflict should first „sleep over it“, then decide how to proceed.

Peinlich

Konflikt. Conflict. Latin conflictus. Collision, hitting, crashing together; a difficult situation caused by opposing opinions; to go against something, to argue, battle, fight with another.

Streit. Argument. Old High German strīt. To go against, uproar, to argue against each other vociferously; to bicker, to argue loudly, emotionally, intensely, including physical attacks. A term used in the past for battle, military confrontation. To arm yourself for a Streit.

Auseinandersetzung. To address an issue at length; discuss, debate, argue; sharp, bitter verbal confrontation; conflict between peoples fought militarily.

Peinlich. Embarrassing. From Middle High German pīnlich. Painful, from pein, pain; Latin poena, punishment; feeling of discomfort, unease, shame.

Überspielen. To hide something negative, cover up; to distract from an embarrassment; to refer to a negative situation with humour so as to mask it.

Petzen. To „rat on“ another person. Germans team members are very reluctant to go to their team lead in order to inform about a problem or another team member‘s poor work.

Denunzieren. To denounce. To go to an authority in order to provide negative or incriminating information about another person. To be an informant.

Lobgeiz

Lobgeiz. There is no such word in German. It is a creation out of Lob, praise and Geiz, stinginess. An unwillingness to give praise where it has been earned. The Germans can be long on criticism and very short on praise.

Nicht geschimpft, ist genug gelobt translates into “Not criticized is praise enough.” Or perhaps the scanty praise they give is enough for the Germans. They are certainly not lacking in self-esteem, motivation, ambition or drive.

The Germans speak of the happy filter in the U.S. Happy filter? Each time results are reported upwards in an American organization they become more positive, with the goal of keeping the higher-ups in the hierarchy happy. It can become a kind of incrementally inflated euphoria. Self-intoxicating. A step-by-step distancing from a sober assessment of reality. “Don’t worry. Be Happy.“

Discernment

Discernment: the right to choose what should be done in a particular situation; the quality of being careful about what you do and say so that people will not be embarrassed or offended; the quality of being discreet.

Showing discernment or good judgment: the ability to make responsible decisions; individual choice or judgment; the power of free decision or latitude of choice within certain legal bounds; separating or distinguishing.

Off-line

Discretion: The quality of having or showing good judgment; ability to make responsible decisions; individual choice or judgment; power of free decision or latitude of choice within certain legal bounds; the result of separating or distinguishing.

Off-line: Americans prefer to discuss sensitive matters „off-line“, meaning to do so privately, one-to-one, separate from the other team members. A capable team lead knows how to practice this kind of discretion while signaling to the other team members that the sensitive issues are being addressed and not „swept under the rug.“

humiliate: To reduce to a lower position in one’s own eyes or others’ eyes. From late Latin humiliate – ‘made humble,’ from the verb humiliare.

Cohesion: The act of forming a united whole. Mid 17th century from Latin cohaes – ‘cleaved together,’ from the verb cohaerere, on the pattern of adhesion.

During World War II, on August 3, 1943, General George Patton slapped a soldier who was hospitalized for psychoneurosis, accusing him of cowardice. The incident nearly ended Patton’s career. A week later, in a far less publicized incident, Patton slapped another soldier, who had been hospitalized for his “nerves.” Many members of Congress and the press called for Patton’s removal from command.

Bobby Knight, one of America‘s most innovative and successful college basketball coaches, was known for his straight-talking, open, honest and impatient, combative personality. After almost thirty years of extraordinary success at the University of Indiana, Knight was fired for very minor indiscretions involving players and students. Mr. Knight once said: “When my time on earth is gone, and my activities here are past, I want them to bury me upside down, so that my critics can kiss my ass.”

Wayne “Woody” Hayes (1913-1987) was the football coach at Ohio State University for over twenty-five years, with a career record of 238 wins 72 losses and 10 ties, winning five national championships. Hayes challenged his players to be the best, often becoming impatient and angry, at times physically rough with them during practices. His career was ended after a 1978-game in which he physically attacked a player on the opposing team.

Criticism in Front of Colleagues

Criticism of an individual team member in the presence of the team is an accepted way in which Germans make that individual aware of a weakness or reoccuring error and request that it be addressed. Not only management, but also colleagues, are authorized – and expected – to voice open criticism, to point out what is not working. This kind of open criticism is not considered to be negative.

Open criticism of colleagues is considered negative, however, if it is not aimed at improving performance, but instead in gaining advantage within the team at the expense of that individual colleague.

rügen. To upbraid, to criticize, to admonish; to point out a weakness or failure; to set someone straight.

Jemanden zur Schnecke machen. Figuratively to make some into a snail. To complain to and about someone, to put down harshly, to set someone straight in a direct and harsh way.

Discretion. To hold something private, secret; to be entrusted; to be tactful, considerate, reserved; not pushy.

Pranger. Pillory. A stone column located in the middle of the village to which individuals are chained for a period of time as a form of punishment for a petty crime. Townspeople would often slap or hit them, throw trash at them, or otherwise humiliate them. To put someone on the Pranger means to criticize, even embarrass them in front of the organization.
