The date must be agreed, not imposed

That automatic default only applies where the date was fixed by contract, by statute or by court judgment. A payment deadline written unilaterally on an invoice does not count — the Federal Court of Justice has held that it is merely an offer of credit terms.

A deadline one party announced is not a deadline. It has to have been agreed.

The negotiation record

Das Verhandlungsprotokoll. German negotiations produce a written record of what was proposed, what was objected to, and what was agreed, circulated afterwards and corrected. Whatever was felt in the room does not survive into the document. Only the positions do.

Surge pricing

The price of a ride changes with demand, minute to minute, and the passenger is shown a multiplier before accepting. It generated substantial public complaint and it did not go away. The argument that won was that the price is doing its job.

The equity ratio

Eigenkapitalquote. German Mittelstand companies carry notably high equity ratios by international standards, and treat it as a matter of prudence rather than inefficiency. Debt is capacity you have already spent. Equity is the buffer that lets a firm survive a year it did not plan for.

Separate the person from the problem

American negotiation and management training teaches it explicitly, from Getting to Yes onward, and it appears in feedback courses, mediation training and manager onboarding. It is taught because it does not come naturally. A culture where work and person were already distinct would have no curriculum for prising them apart.

The written warning

Die Abmahnung. German employment law generally requires a formal written warning before a conduct-based dismissal, stating the behaviour, why it is unacceptable, and what happens if it recurs. The employer cannot escalate directly. The law inserts a step and requires it to be documented.

The earnings call

American public companies hold a quarterly call in which executives take questions from analysts, and the recording and transcript are made public. The company’s own account of its performance is delivered in a forum it does not control, and anyone can listen.

Six Sigma

Developed at Motorola in 1986 and adopted across American manufacturing and services. Its core cycle — Define, Measure, Analyze, Improve, Control — begins with measurement of what is actually happening. The improvement is derived from the data, and the control phase exists to hold the derived process in place until the next measurement.
