The expert opinion precedes the decision

A German decision of any weight is preceded by a Gutachten — a commissioned written report by a qualified expert, produced on its own timetable and forming a document in its own right.

Building disputes, medical questions, insurance claims, environmental approvals, legislation. The analysis is a deliverable with an author who is answerable for it, not a stage of somebody’s thinking.

Buffer time

Buffer time. German project planning builds slack into the schedule itself, allocated to specific stages and carried in the plan. It is not contingency held to one side. It is time that was planned, for events that were not.

Whose work it is

That’s Mike’s project. She owns the redesign. He built that. Her numbers. American workplace speech attaches work to a named person as a matter of routine, in praise and in criticism alike. The attribution is automatic, and it runs both ways.

The status report

German project practice runs on a scheduled report — monthly, fortnightly, at defined milestones — rather than on continuous contact. The client is informed regularly and is not consulted continuously. The rhythm is agreed at the start, and keeping to it is what maintains the relationship.

The complaints body

Die Beschwerdestelle. German equal treatment law requires every employer to designate a body to which employees may bring complaints, and to inform staff that it exists. The route out of a private grievance is provided in advance, by statute.

Knowledge carriers

Der Wissensträger — the knowledge carrier. A German term for the person in whom a body of expertise sits.

Wissen ist Macht — knowledge is power, said in German with no irony and no particular objection.

The team’s knowledge is spoken of as something held, carried and accumulated, rather than as something that circulates.

At-will

The default American employment relationship can be ended by either side at any time, for any lawful reason, without notice. There is no equivalent of a statutory notice period accruing with service. Availability is not protected by anything.

The further period

Where performance is late, a German creditor generally cannot simply withdraw from the contract. He must first set a reasonable further period and let it run — § 323 Abs. 1 BGB. The law builds a second chance into lateness. What is not tolerated is the failure that survives the second chance.
