The Authority Finds the Facts

The authority investigates the facts of its own motion. That is § 24 of the Administrative Procedure Act. The authority decides the kind and extent of the investigation. It is not bound by what the parties submit or by their requests for evidence.

The same section adds a duty in the other direction. The authority must consider all circumstances that matter in the individual case, auch die für die Beteiligten günstigen, including those in the parties’ favor.
