When a patient in an American hospital insists on leaving before the doctors agree, staff may ask the patient to sign a form saying the discharge is “against medical advice.” This happens about 500,000 times a year, 1% to 2% of all discharges.
Many clinicians assume this label protects them from liability. A 2017 article in the Journal of Hospital Medicine found that “the claim is not supported by the available literature.”
